1 Acceptance of Terms & Contracting Parties

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Subscriber", "You") and AuctionDekho Internet Services Private Limited ("AuctionDekho", "Company", "We", "Us").

Your access to and use of our website (http://auctiondekho.co.in), digital APIs, subscription plans, and offline due diligence services is conditioned on your acceptance of and compliance with these Terms. If you disagree with any part of these terms, you must immediately terminate use of our platform.

2 Platform Nature & Crucial Statutory Disclaimer

Users explicitly understand and agree to the following statutory principles:

• All bank auction notices, property descriptions, Reserve Prices, Earnest Money Deposit (EMD) requirements, and bidding timelines displayed on the portal are conducted independently by statutory secured creditors (such as State Bank of India, Punjab National Bank, Bank of Baroda, Canara Bank, Union Bank of India, etc.) under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) or the Recovery of Debts and Bankruptcy Act, 1993 (DRT).
• AuctionDekho indexes public newspaper gazettes and official bank tenders for informational convenience. We do not participate in bidding, do not manage bidding software, and do not accept or hold bidder EMD funds.
• Mandatory Buyer Due Diligence: Users are strictly required to independently inspect the original gazette notice, visit physical property locations, and verify title, encumbrance, and municipal dues directly with the respective bank's Authorised Officer prior to submitting any financial bid or EMD deposit.

3 Description of Commercial Services

AuctionDekho provides two distinct categories of commercial services:

4 User Account, Security & Anti-Scraping Policy

When registering an account on AuctionDekho, you agree to:

• Provide truthful, accurate, and current contact details (name, email, and mobile number).
• Maintain sole confidentiality of your login credentials. Each subscription is tied to a single user profile and may not be shared, rented, or resold to third parties.
• Strict Anti-Scraping & Bot Prohibition: You agree not to utilize automated spiders, headless scrapers, curl routines, or bulk harvesting scripts against our database or document endpoints. Any automated extraction or database mirroring is a criminal violation under Section 43 & Section 66 of the Information Technology Act, 2000, resulting in immediate permanent account termination without refund, alongside statutory damages.

5 Billing, Payments & Taxes

• All pricing displayed on the platform is denominated in Indian National Rupees (INR). Commercial invoices are subject to applicable Indian Goods and Services Tax (GST 18%).
• Payments are processed securely via RBI-authorized Payment Aggregators (Razorpay / Cashfree) adhering to PCI-DSS Level 1 compliance.
• Subscriptions are billed in advance on a recurring monthly or annual basis unless cancelled prior to renewal via the account dashboard.

6 Limitation of Liability & Indemnification

To the maximum extent permitted under applicable Indian law, AuctionDekho, its directors, officers, employees, and empanelled consultants shall not be liable for:

• Any postponement, rescheduling, withdrawal, or cancellation of an auction sale by the secured creditor bank or Authorised Officer.
• Any DRT (Debt Recovery Tribunal), DRAT, High Court, or Supreme Court interim stay orders obtained by borrowers, tenants, or third parties against the auction sale.
• Technical malfunctions, downtime, session timeouts, or digital signature certificate (DSC) errors occurring on upstream bank e-auction portals (e.g., MSTC, IBAPI, BankAuctions, AuctionTiger).
• Any financial losses, bid forfeiture, or legal expenses incurred arising out of auction bidding decisions. All bank auction purchases are conducted strictly on an "As is where is", "As is what is", and "Whatever there is" basis under SARFAESI Rule 8(6).

7 Intellectual Property Rights

The AuctionDekho brand, logos, user interface layout, database curation algorithms, micro-market taxonomy, and address parsing intelligence are the exclusive intellectual property of AuctionDekho Internet Services Private Limited, protected under Indian Copyright and Trademark laws. Official gazette notice texts and bank auction advertisements remain the statutory property of their respective originating banks.

8 Governing Law & Dispute Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. In the event of any claim, controversy, or dispute arising out of or related to these Terms or the use of our services, the parties submit to the exclusive jurisdiction of the competent courts in Gurugram / New Delhi, India.
