The Complete SARFAESI Bidding & Due Diligence Master Guide
Everything retail buyers and high-net-worth investors must know before bidding on distressed bank real estate under the SARFAESI Act, 2002.
1. Physical Possession vs. Symbolic Possession
Crucial distinction that dictates immediate occupancy vs. legal follow-up
The bank has legally taken over actual physical custody of the locks and keys with assistance from the Chief Metropolitan Magistrate (CMM) or District Magistrate (DM) under Section 14 of the SARFAESI Act.
- Property is vacant and unoccupied.
- Immediate handover of keys upon final payment.
- Recommended for end-users seeking prompt moving in.
The bank has issued constructive possession notices under Section 13(4) on paper, but the borrower, tenant, or licensee may still physically occupy or retain the keys of the premises.
- The bank must execute Section 14 via DM/CMM order to evict.
- Can take between 3 to 9 months for physical keys.
- Traded at a steeper discount (often 20% to 40% below market).
2. The 5-Step Bank e-Auction Process
From tender discovery to official Sale Certificate registration
Portal Discovery & Tender Scrutiny
Identify target property on NCR Auction Portal. Check Reserve Price, EMD amount (usually 10% of Reserve Price), auction date, and Authorised Officer contact. Download the statutory 30-day or 15-day public auction notice.
IBAPI / Service Provider Portal Registration & KYC
Register on the official e-auction platform designated in the notice (MSTC, e-Bikray / IBAPI, AuctionTiger, or C1 India). Complete PAN and Aadhaar KYC verification 48-72 hours prior to the auction deadline.
EMD Wallet Transfer (RTGS / NEFT)
Transfer the exact 10% Earnest Money Deposit into your auction virtual account via RTGS/NEFT before the application deadline. Unsuccessful bidders receive a full 100% refund into their linked bank account within 24 to 48 hours without any deduction.
Live e-Bidding Window
On auction day (typically between 11:00 AM to 1:00 PM), place bids exceeding the Reserve Price by the incremental value (typically ₹25,000 to ₹1,00,000). The auction platform provides dynamic 5-minute auto-extensions for last-minute competitive bids.
Payment Schedules & Sale Certificate Issuance
Upon winning:
- Day of Auction or Next Business Day: Pay 15% balance to complete 25% of the total bid price.
- Within 15 Days (extendable up to 90 days with bank consent): Pay remaining 75% balance.
- Conveyance: Bank issues official Sale Certificate under Rule 9(6) of Security Interest (Enforcement) Rules, 2002, free from borrower encumbrances.
3. Non-Negotiable Pre-Bidding Due Diligence Checklist
Do not deposit your 10% EMD without completing these audits
Check if multiple banks or NBFCs have competing equitable mortgages registered against the same property asset.
Under "As is where is, whatever there is", past property tax and apartment maintenance arrears fall on the successful bidder unless specified otherwise in notice.
Verify that the defaulting borrower has not secured an interim stay order from the Debts Recovery Tribunal (DRT) under SARFAESI Section 17.
4. Can You Get a Home Loan on Bank Auction Properties?
Yes, but standard retail loan turnaround times do not apply
A widespread misconception is that bank auction properties cannot be financed. In reality, most nationalized and private banks (including SBI, PNB, HDFC, and ICICI) provide home loans up to 75% of the bid value, provided:
- You secure pre-approval / pre-sanction of your loan before auction day so funds can be disbursed within the strict 15-day window.
- The auctioning bank and the lending bank can execute a tripartite agreement where the title deed is released directly to the financing bank.
- Financing the 25% down payment must always come from your own independent liquid funds.
